Terms of Service
Last updated . The agreement that covers your use of Owlbee.
1. Agreement
These Terms of Service ("Terms") are an agreement between you and Owlbee.AI ("Owlbee", "we", "us") covering your use of owlbee.ai and the Owlbee chatbot service (the "Service"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you use Owlbee for a business, you agree on behalf of that business and confirm you have authority to do so.
You must be at least 18 years old and able to form a binding contract to use the Service.
2. Your account
- Give accurate details when you sign up and keep them up to date.
- Keep your password secret. You are responsible for everything done through your account.
- Tell us straight away at [email protected] if you think someone else has access to your account.
3. The Service
Owlbee lets you build AI chatbots trained on content you provide, add them to websites with an embed snippet, book calls with visitors, and see analytics. Features, AI models, the number of chatbots, file sizes and monthly usage depend on your plan. We improve the Service all the time and may add, change or remove features. If we remove a major feature you pay for, we will tell you in advance.
Some features rely on third-party services, such as OpenAI for AI replies, Stripe for payments and the platform your website runs on. We are not responsible for those services, and their availability can affect Owlbee.
4. Plans, billing and renewal
- Subscriptions. Paid plans are billed in advance, monthly or yearly, through Stripe, and renew automatically at the end of each period until cancelled. Prices are shown on the Plans page and exclude any taxes that apply.
- Cancelling. To cancel, email [email protected] from your account's email address before your next renewal date. Your plan stays active until the end of the period you have paid for and then does not renew.
- Price changes. We will give you at least 30 days' notice of a price increase, which applies from your next renewal. You can cancel before then if you do not want to continue.
- Failed payments. If a payment fails, we may pause paid features until it is resolved.
5. 30-day money-back guarantee
If you are not happy with a paid plan, email [email protected] within 30 days of your first payment for that plan and we will refund that payment in full. The guarantee applies once per customer. Apart from this guarantee, or where the law requires otherwise, payments are non-refundable, including for partly used periods.
6. Free trials
Plans marked as a free trial run for the number of days shown on the plan, counted from when you join it. No card is needed. When the trial ends your chatbots stop answering and you cannot create or train chatbots until you move to a paid plan. Your chatbots and documents are kept, so upgrading switches them back on. We may change or end free trial offers for new sign-ups at any time.
7. Usage allowances
Each plan includes a monthly AI usage allowance, measured in tokens and reset at the start of each calendar month (UTC). When a chatbot's owner reaches the allowance, their chatbots reply with a short message instead of an AI answer until the allowance resets or the plan is upgraded. Unused allowance does not carry over. There are no automatic overage charges.
8. Your content
"Your content" means the documents, links, instructions and other material you give us, and the conversations and bookings your chatbots collect. You own your content. You give us a worldwide, non-exclusive licence to host, copy, process and display it only as needed to provide and support the Service for you, including sending it to the service providers listed in our Privacy Policy.
You confirm that you have the rights to the content you upload or link, including any website you ask Owlbee to read, and that using it with the Service does not break any law or anyone else's rights.
9. Your chatbots and your visitors
When you put an Owlbee chatbot on a website, you are responsible for how it is used there. In particular you agree to:
- Tell your website's visitors, in your own privacy notice, that you use an AI chatbot provided by a third party and how you use the conversations and booking details it collects.
- Have a lawful basis for the information your chatbot collects, and handle visitors' privacy requests. We will help you where we can.
- Not configure a chatbot to ask for health, financial or other sensitive information, payment card details, passwords, or information from children.
- Make clear to visitors that they are talking to an automated assistant, not a person.
10. AI-generated answers
Chatbot replies, drafts made by Build Your Bot and keyword analysis are produced by AI. AI can be inaccurate, incomplete or out of date even when it is trained on your own content. You are responsible for reviewing your chatbot's instructions and content, testing it before you put it live, and for the answers it gives on your website. Do not use Owlbee to give medical, legal, financial or other professional advice, or for decisions that have legal or similarly significant effects on people.
11. Acceptable use
You must not use the Service to:
- break the law or help anyone else do so, including consumer protection, privacy, anti-spam and intellectual property laws;
- deceive or defraud people, impersonate anyone, or publish false or misleading claims;
- create or spread content that is hateful, harassing, sexually explicit, violent or otherwise harmful;
- upload malware, or try to break, overload, probe or get around the security or limits of the Service;
- use Owlbee to reach systems or websites you are not allowed to access;
- resell or provide the Service to others as your own product without our written agreement;
- copy, reverse engineer or build a competing product from the Service.
12. Our property
Owlbee, the Service, our software, design and brand belong to Owlbee.AI and its licensors. These Terms give you the right to use the Service while your account is active; they do not transfer any ownership to you. If you send us ideas or feedback, we may use them without any obligation to you.
13. Suspension and termination
You can stop using Owlbee at any time and ask us to delete your account by emailing [email protected]. We may suspend or close an account that breaks these Terms, fails to pay, or puts the Service, other customers or the public at risk. Where reasonable we will warn you first and give you a chance to fix the problem. When an account is closed, its chatbots stop working and its content is deleted as described in our Privacy Policy.
14. Disclaimers
We work hard to keep Owlbee available and useful, but the Service is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement, and we do not promise that the Service will be uninterrupted or error-free.
15. Limitation of liability
To the fullest extent the law allows, Owlbee.AI will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to the Service. Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim arose and US $100. Some jurisdictions do not allow these limits, so they may not all apply to you.
16. Indemnity
If someone makes a claim against Owlbee because of your content, your chatbots, your website or your breach of these Terms, you agree to cover the reasonable costs and losses that result, including legal fees.
17. Governing law and disputes
These Terms are governed by the laws of the United States and of the state in which Owlbee.AI has its principal place of business, without regard to conflict-of-law rules. Before bringing a claim, please contact us at [email protected] so we can try to resolve it informally.
18. Changes to these Terms
We may update these Terms as the Service changes. We will change the "last updated" date above and, for significant changes, tell customers by email or in the app at least 14 days before they take effect. If you keep using Owlbee after that, the new Terms apply. If you do not agree, you can cancel before they take effect.
19. General
These Terms and the Privacy Policy are the whole agreement between you and us about the Service. If part of these Terms cannot be enforced, the rest stays in effect. If we do not enforce a right straight away, we have not given it up. You may not transfer these Terms without our consent. We may transfer them as part of a merger or sale of our business.
